Two-Year Sentence for Employers Liability Fraudster

 

A judge at Liverpool Crown Court has handed a two-year custodial sentence to a man who has been found guilty of fraud as a result of the lies he told in order to make a £700,000 employers’ liability insurance claim.

Although it is understood that the employers’ liability insurance claimant did actually fall through the roof in a 2011 construction accident, the court heard that he greatly exaggerated the severity of his injuries.

He had several opportunities to settle his claim but, rather than take the offers that were on the table, he instead argued that he was suffering from a litany of serious and debilitating injuries that reduced his ability to live an independent life – for example, he said he relied on the use of a crutch and could no longer carry a bag of shopping.

However, surveillance footage obtained by the business insurance company in the case showed that the claimant was able to walk freely for long distances and that the only time he used a crutch was when he was on the way to medical appointments. The court was also shown footage of him climbing a ladder while working as a roofer.

The judge at Liverpool Crown Court told the employers’ liability insurance defendant, “Your offences are not victimless offences. Fraud causes losses that affect society at large.”

As fraudulent claims can increase the cost of insurance premiums for other businesses, this case will hopefully act as a deterrent to other fraudsters who are planning to deceive insurers by making dishonest claims.
